Terms of Use

1. Scope and Relationship to Other Terms

ART Coach is developed and operated by Jose Velez. These Terms of Use govern access to and use of ART Coach websites, support pages, and related non-licensed service interactions (collectively, "Services").

Use of the ART Coach application software itself is governed by Apple's Standard EULA. ART Coach does not provide a separate custom EULA. If there is a conflict regarding software licensing, Apple's Standard EULA controls. Our Privacy Policy explains how data is handled.

2. Acceptance

By accessing or using the Services, you agree to these Terms of Use, the EULA (as applicable), and the Privacy Policy.

If you do not agree, do not use the Services.

3. Eligibility and Compliance

You agree that you:

• Are legally able to accept these Terms
• Will comply with applicable laws and regulations
• Will provide accurate information when contacting support

4. Service Description

ART Coach provides calculation, planning, educational, export, and measurement-readiness tools for audio configuration workflows. Its room-noise features assess background-noise conditions only. ART Coach does not perform room-correction measurements, generate correction filters, connect to or control third-party calibration software or processors, or automatically apply settings.

Results depend on variables outside our control, including room acoustics, speaker placement, equipment limitations, and measurement quality. The Services provide guidance, not guaranteed outcomes.

You are responsible for validating settings against your equipment limits, listening levels, and safety requirements. We do not guarantee compatibility with every hardware or software combination, specific acoustic outcomes, or that recommendations will avoid equipment damage or hearing risk.

5. Acceptable Use

You may not:

• Use the Services in violation of law
• Attempt unauthorized access to systems, accounts, or data
• Interfere with service operation, reliability, or security
• Misrepresent affiliation with ART Coach
• Use content in a way that infringes intellectual property or other rights

6. Purchases and Commercial Terms

ART Coach Pro is an optional one-time, non-consumable in-app purchase processed by Apple.

• Billing and payment processing are handled by Apple
• The price and availability shown by Apple at the time of purchase control
• Refund requests are handled under Apple's policies
• Restore Purchases is available in the App for an eligible existing purchase
• Feature sets may evolve over time

Free mode includes full core calculation and export workflows. Pro adds workflow convenience and depth, and does not guarantee specific acoustic performance.

7. Third-Party Software and Trademarks

ART Coach is independent and is not affiliated with Dirac Research AB.

Dirac® and Dirac Live® are registered trademarks of Dirac Research AB. You are responsible for separately obtaining compatible hardware, software, and any room-correction, Active Room Treatment, or bass-control licenses required for your system, and for complying with the applicable third-party terms.

8. Your Content, Imports, and Exports

You retain any rights you have in configuration data, notes, names, and files you create or import. Using the App does not upload that content to an ART Coach server. If you export, copy, or share content, you choose the destination and are responsible for confirming that you have the right to use and share it and that the destination is appropriate.

9. Intellectual Property

Except for your content described above, all Service content (including text, graphics, branding, and compiled materials) is owned by or licensed to us and protected by law.

You may not reproduce, distribute, or create derivative works from Service content except as expressly permitted.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

No information provided through the Services constitutes professional engineering, acoustic, electrical, legal, or medical advice.

11. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct or gross negligence, or death or personal injury caused by negligence where such a limitation is prohibited. Applicable statutory consumer rights remain unaffected.

SUBJECT TO THOSE RIGHTS AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICES.

Subject to the foregoing, our aggregate liability arising from or relating to the Services will not exceed the greater of fifty U.S. dollars (US $50) or the amount you paid for ART Coach Pro during the twelve (12) months preceding the event giving rise to the claim.

12. Termination

We may suspend or terminate access to Services if you materially violate these Terms or if required for legal, operational, or security reasons.

You may stop using the Services at any time.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Illinois, United States, excluding conflict-of-law rules.

Except where prohibited by law, disputes will be resolved in the state or federal courts located in Cook County, Illinois.

14. Changes to Terms

We may update these Terms from time to time. Material changes are communicated by posting revised Terms and updating the date above. Continued use after effective updates constitutes acceptance unless additional consent is required by law.
